Common illegal clauses

These are the ones we find most often. The analysis is not limited to them — every clause in your contract is matched against the statute.

Not "this looks risky". The article, the certainty, what to do.

Drawing up and signing the contract is the landlord’s own cost. The law does not allow it to be passed on to the tenant as a fee, and a clause that does so has no legal effect — including one you have already signed and paid.

Art. 7:264 BWExplicit in the statute
What to doWrite to your landlord that the administration fee has no legal effect under Art. 7:264 BW and ask for it to be refunded. Keep the request in writing.
Worth checking

Charging an advance is allowed. Whether this one works against you depends on something the contract does not say: whether you actually receive a statement each year.

In the report they are grouped the same way: clauses that conflict with the law, and clauses worth checking.
